Yorktown Man Arrested For Controlled Substance Possession & Sale Following Fatal Overdose

Yorktown Police report the arrest of a 30-year-old Yorktown man, who is charged with Criminal Sale of a Controlled Substance 3rd Degree and Criminal Possession of a Controlled Substance with Intent to Sell 3rd Degree, both of which are Class “B” Felonies, as well as Criminal Contempt in the 2nd Degree, a Class “A” Misdemeanor.  
 
On October 26, 2023, at approximately 3:00 PM, Yorktown Police responded to a residence on East Main St. for an apparent fatal overdose. Yorktown Police Detective Hannigan was assigned to investigate the incident.  Upon conclusion of the investigation, it is alleged that the defendant possessed and then sold a quantity of a controlled substances to the victim, which allegedly resulted in the victim’s death. 
 
On February 15, 2024, the defendant was located outside of his residence and was taken into custody by Detective Hannigan and PO Montero during a vehicle and traffic stop. Furthermore, it is alleged that the defendant violated a duly served and active “Stay Away” Temporary Order of Protection issued by Westchester Family Court which stipulated that the defendant stay away from the listed victim, the operator of the vehicle.
 
The defendant was transported to Yorktown Police Headquarters where he was processed on the above listed charges.  After processing on the above charges, the defendant was arraigned by the Honorable Aviah Cohen-Pierson in the Yorktown Justice Court.  Bail was set in the amount of $50,000 cash, $100,000 bond, or $150,000 partially secured bond.  The defendant, unable to post bail at this time, was remanded to Westchester County Jail.  The defendant is due to appear in the Yorktown Justice Court on February 20, 2024 at 6:00 pm.
 
The investigation was assisted by the Westchester County Department of Public Safety Forensic Investigation Unit as well as the Westchester County District Attorney’s Office.

4 Days, 4 Drunk/Impaired Driving Arrests

Yorktown Police report the arrest of a 21 year-old, Yorktown, NY resident, who is charged with Driving While Intoxicated 1st Offense, an Unclassified Misdemeanor, as well as Operate with an Unregistered Motor Vehicle, Imprudent Speed, and Fail to Use Designated Lane, all of which are Traffic Infractions.
 
On February 12, 2024 at approximately 2:54 AM, P.O. Vuoso was conducting routine patrol when he observed a one car motor vehicle accident.  P.O. Vuoso observed a male located in the driver’s seat of the vehicle which had been involved in an accident and was off the roadway in a stream.  PO Vuoso conducted an investigation and the defendant was identified.  After completing an investigation at the scene, it is alleged that the defendant was driving while intoxicated, with an unregistered motor vehicle, and was traveling at an imprudent speed causing him to fail to use a designated lane.  The defendant was placed under arrest and transported to the Westchester Medical Center for treatment of injuries sustained during the accident.
 
The defendant was issued uniform traffic tickets for the above listed charges and was released on his own recognizance to the care of hospital staff. The defendant is due to appear in Yorktown Justice Court on February 22, 2024 at 6:00 PM. 

 Yorktown Police report the arrest of a 55-year-old Lake Peekskill, NY resident who is charged with Driving While Intoxicated 1st Offense and Aggravated Driving While Intoxicated BAC .18% or More, both Unclassified Misdemeanors, as well as, Failure to comply with lawful order, Failure to use designated lane, Consumption of alcohol in motor vehicle, and Leaving the scene of a property damage accident, all Traffic Infractions.
 
 On February 11, 2024 at 11:03 PM, Yorktown Police were dispatched to a property damage motor vehicle accident in the area of Crossways Rd.  It was reported that a vehicle left the scene of the accident and a vehicle description was provided.  While responding, PO Uhl observed a vehicle matching that description on Barger St.  PO Uhl attempted to perform a traffic stop of the vehicle with emergency lights and sirens activated.  It is alleged that the vehicle failed to stop in a reasonable amount of time and continued driving.  PO Uhl continued following the vehicle and it is alleged that the vehicle failed to use its designated lane.  The vehicle eventually came to a stop on Route 6 and the operator was identified as the defendant.  After an investigation was conducted it is alleged that the defendant was consuming alcohol in the vehicle and was driving while intoxicated.  The defendant was placed under arrest and transported to the Yorktown Police Department for processing.  After further investigation at the Yorktown Police Department it is alleged that the defendant operated a motor vehicle with a BAC of .18% or more and left the scene of a property damage accident.
    
After processing was completed the defendant was issued traffic tickets for the above charges and released on her own recognizance to a responsible adult.  The defendant is due to appear in the Yorktown Justice Court on February 22, 2024 at 6:00 PM.  

Yorktown Police report the arrest of a 34-year-old Pound Ridge, NY resident who is charged with Driving While Intoxicated 1st Offense and Driving While Intoxicated BAC .08% or More, Aggravated Unlicensed Operation 3rd degree, all Unclassified Misdemeanors, as well as, Disobey a traffic control device and Failure to use designated lane, fail to keep right, and unlicensed operator, all Traffic Infractions.
 
On February 10, 2024 at 4:19 AM, PO Pagliuca was dispatched to a vehicle that was involved in a single vehicle traffic accident, having struck a tree. PO Pagliuca spoke with the operator of the vehicle, identified as the defendant, and began her investigation. At the completion of an investigation at the scene it is alleged that the defendant was driving while intoxicated by alcohol. The defendant was placed under arrest at the scene and transported to the Yorktown Police Department for processing.  After further investigation at the Yorktown Police Department it is alleged that the defendant operated a motor vehicle with a BAC of .08% or more and was allegedly operating the motor vehicle while her driver’s license was suspended.
 
After processing was completed the defendant was issued traffic tickets for the above charges and released on her own recognizance to a responsible adult.  The defendant is due to appear in the Yorktown Justice Court on February 20, 2024 at 6:00 PM.  

Yorktown Police report the arrest of a 35-year-old, Yorktown, NY resident, who is charged with Driving While Impaired by Drugs 1st Offense, an Unclassified Misdemeanor as well as several additional traffic infractions.
 
On February 9, 2024 at approximately 2:45 AM, P.O. Delgado was on routine patrol on Hallocks Mill Rd, when he observed a vehicle pulled to the side of the road. PO Delgado observed a male operator asleep in the driver’s seat with the vehicle running.  PO Delgado conducted an investigation, and the operator was identified as the defendant.  After completing an investigation at the scene, it is alleged that the defendant was Driving While Impaired by Drugs. The defendant was placed under arrest and transported to Yorktown Police Department Headquarters for arrest processing.
 
Following processing on the charges, the defendant was issued a uniform traffic ticket for the above listed charge and was released on his own recognizance to a responsible third party. The defendant is due to appear in Yorktown Justice Court on February 20, at 6:00 PM.
