Yorktown Police report the arrest of a 30-year-old Yorktown man, who is charged with Criminal Sale of a Controlled Substance 3rd Degree and Criminal Possession of a Controlled Substance with Intent to Sell 3rd Degree, both of which are Class “B” Felonies, as well as Criminal Contempt in the 2nd Degree, a Class “A” Misdemeanor.
On October 26, 2023, at approximately 3:00 PM, Yorktown Police responded to a residence on East Main St. for an apparent fatal overdose. Yorktown Police Detective Hannigan was assigned to investigate the incident. Upon conclusion of the investigation, it is alleged that the defendant possessed and then sold a quantity of a controlled substances to the victim, which allegedly resulted in the victim’s death. On February 15, 2024, the defendant was located outside of his residence and was taken into custody by Detective Hannigan and PO Montero during a vehicle and traffic stop. Furthermore, it is alleged that the defendant violated a duly served and active “Stay Away” Temporary Order of Protection issued by Westchester Family Court which stipulated that the defendant stay away from the listed victim, the operator of the vehicle. The defendant was transported to Yorktown Police Headquarters where he was processed on the above listed charges. After processing on the above charges, the defendant was arraigned by the Honorable Aviah Cohen-Pierson in the Yorktown Justice Court. Bail was set in the amount of $50,000 cash, $100,000 bond, or $150,000 partially secured bond. The defendant, unable to post bail at this time, was remanded to Westchester County Jail. The defendant is due to appear in the Yorktown Justice Court on February 20, 2024 at 6:00 pm. The investigation was assisted by the Westchester County Department of Public Safety Forensic Investigation Unit as well as the Westchester County District Attorney’s Office. Yorktown Police report the arrest of a 21 year-old, Yorktown, NY resident, who is charged with Driving While Intoxicated 1st Offense, an Unclassified Misdemeanor, as well as Operate with an Unregistered Motor Vehicle, Imprudent Speed, and Fail to Use Designated Lane, all of which are Traffic Infractions. On February 12, 2024 at approximately 2:54 AM, P.O. Vuoso was conducting routine patrol when he observed a one car motor vehicle accident. P.O. Vuoso observed a male located in the driver’s seat of the vehicle which had been involved in an accident and was off the roadway in a stream. PO Vuoso conducted an investigation and the defendant was identified. After completing an investigation at the scene, it is alleged that the defendant was driving while intoxicated, with an unregistered motor vehicle, and was traveling at an imprudent speed causing him to fail to use a designated lane. The defendant was placed under arrest and transported to the Westchester Medical Center for treatment of injuries sustained during the accident. The defendant was issued uniform traffic tickets for the above listed charges and was released on his own recognizance to the care of hospital staff. The defendant is due to appear in Yorktown Justice Court on February 22, 2024 at 6:00 PM. Yorktown Police report the arrest of a 55-year-old Lake Peekskill, NY resident who is charged with Driving While Intoxicated 1st Offense and Aggravated Driving While Intoxicated BAC .18% or More, both Unclassified Misdemeanors, as well as, Failure to comply with lawful order, Failure to use designated lane, Consumption of alcohol in motor vehicle, and Leaving the scene of a property damage accident, all Traffic Infractions. On February 11, 2024 at 11:03 PM, Yorktown Police were dispatched to a property damage motor vehicle accident in the area of Crossways Rd. It was reported that a vehicle left the scene of the accident and a vehicle description was provided. While responding, PO Uhl observed a vehicle matching that description on Barger St. PO Uhl attempted to perform a traffic stop of the vehicle with emergency lights and sirens activated. It is alleged that the vehicle failed to stop in a reasonable amount of time and continued driving. PO Uhl continued following the vehicle and it is alleged that the vehicle failed to use its designated lane. The vehicle eventually came to a stop on Route 6 and the operator was identified as the defendant. After an investigation was conducted it is alleged that the defendant was consuming alcohol in the vehicle and was driving while intoxicated. The defendant was placed under arrest and transported to the Yorktown Police Department for processing. After further investigation at the Yorktown Police Department it is alleged that the defendant operated a motor vehicle with a BAC of .18% or more and left the scene of a property damage accident. After processing was completed the defendant was issued traffic tickets for the above charges and released on her own recognizance to a responsible adult. The defendant is due to appear in the Yorktown Justice Court on February 22, 2024 at 6:00 PM. Yorktown Police report the arrest of a 34-year-old Pound Ridge, NY resident who is charged with Driving While Intoxicated 1st Offense and Driving While Intoxicated BAC .08% or More, Aggravated Unlicensed Operation 3rd degree, all Unclassified Misdemeanors, as well as, Disobey a traffic control device and Failure to use designated lane, fail to keep right, and unlicensed operator, all Traffic Infractions. On February 10, 2024 at 4:19 AM, PO Pagliuca was dispatched to a vehicle that was involved in a single vehicle traffic accident, having struck a tree. PO Pagliuca spoke with the operator of the vehicle, identified as the defendant, and began her investigation. At the completion of an investigation at the scene it is alleged that the defendant was driving while intoxicated by alcohol. The defendant was placed under arrest at the scene and transported to the Yorktown Police Department for processing. After further investigation at the Yorktown Police Department it is alleged that the defendant operated a motor vehicle with a BAC of .08% or more and was allegedly operating the motor vehicle while her driver’s license was suspended. After processing was completed the defendant was issued traffic tickets for the above charges and released on her own recognizance to a responsible adult. The defendant is due to appear in the Yorktown Justice Court on February 20, 2024 at 6:00 PM. Yorktown Police report the arrest of a 35-year-old, Yorktown, NY resident, who is charged with Driving While Impaired by Drugs 1st Offense, an Unclassified Misdemeanor as well as several additional traffic infractions.
On February 9, 2024 at approximately 2:45 AM, P.O. Delgado was on routine patrol on Hallocks Mill Rd, when he observed a vehicle pulled to the side of the road. PO Delgado observed a male operator asleep in the driver’s seat with the vehicle running. PO Delgado conducted an investigation, and the operator was identified as the defendant. After completing an investigation at the scene, it is alleged that the defendant was Driving While Impaired by Drugs. The defendant was placed under arrest and transported to Yorktown Police Department Headquarters for arrest processing. Following processing on the charges, the defendant was issued a uniform traffic ticket for the above listed charge and was released on his own recognizance to a responsible third party. The defendant is due to appear in Yorktown Justice Court on February 20, at 6:00 PM. Yorktown Police report the arrest of a 34-year-old Lewisboro, NY resident who is charged with Criminal Sale of a Controlled Substance 3rd Degree and Criminal Possession of a Controlled Substance with Intent to Sell 3rd Degree, both of which are Class B Felonies.
Yorktown Police report that on October 23, 2023, at approximately 9:31 PM, Yorktown Police responded to a residence on Baldwin Road for an apparent overdose. Upon arrival and despite extraordinary lifesaving efforts on scene by Yorktown Patrol Officers, Yorktown Volunteer Ambulance Corp, and Empress Paramedics, the victim was pronounced deceased. Yorktown Police Detectives Hannigan and Curtis were assigned to investigate the incident. Upon conclusion of the investigation it is alleged that the defendant did possess and sell a quantity of Fentanyl to the victim which allegedly resulted in the Victim’s death. On 1/11/24 the defendant was located outside of his residence and was taken into custody by the Yorktown Police Detective Division. The defendant was transported to Yorktown Police Headquarters where he was processed on the above listed charges. After processing on the above charges, the defendant was arraigned by the Honorable Judge Cohen-Pierson in the Yorktown Justice Court. Bail was set in the amount of $100,000 cash, $200,000 bond, or $300,000 partially secured bond. The defendant, unable to post bail at this time, was remanded to Westchester County Jail. The defendant is due to appear in the Yorktown Justice Court on January 25, 2024 at 1800 hours. The investigation was assisted by the Westchester County Department of Public Safety Forensic Investigation Unit as well as the Westchester County District Attorney’s Office. Yorktown Police report the arrest of a 14-year-old male and a 14 year old female, both from Peekskill, New York, who are each charged with Juvenile Delinquency, the underlying charge if committed by an adult being one count of Making Graffiti and one count of Possession of Graffiti Instruments, both Misdemeanors.
On December 4, 2023, at about 11:30 am, Officers Montero and Cora were dispatched to Route 6 in the area of Mill St. for a report from several passing motorists of two youths spray painting graffiti on the sound barrier wall just east of the intersection. The officers responded and located the 14-year-old defendants in the area. After conducting an investigation, it is alleged that both defendants spray painted several graffiti “tags” on the sound barrier and were allegedly in possession of multiple cans of spray paint. The two juveniles were arrested at the scene and transported to Yorktown Police Headquarters. Their guardians were contacted and were told to responded to Yorktown Police Headquarters as well. The two juveniles were issued appearance tickets and released on their own recognizance to their guardians. They are both scheduled to appear in Westchester County Department of Probation on December 14, 2023 at 9:00 am. Damian Williams, the United States Attorney for the Southern District of New York, Frank A. Tarentino III, the Special Agent in Charge of the New York Field Office of the Drug Enforcement Administration (“DEA”), and Robert Noble, Chief of the Yorktown Police Department, announced that PERRY FREEMAN was charged today with distributing fentanyl that resulted in the death of a victim and illegally possessing ammunition. FREEMAN was arrested and presented today before U.S. Magistrate Judge Andrew E. Krause. U.S. Attorney Damian Williams said: “As alleged, Perry Freeman sold fentanyl to a victim who died a horrific death shortly after taking the drugs. Investigators concluded that the victim parked his car and, with his foot on the gas, passed out from ingesting lethal levels of the drugs allegedly provided by Freeman. The engine sparked a fire that engulfed the vehicle and burned the victim’s body. We also allege that Freeman regularly sold fentanyl to a confidential informant and warned the informant to be careful with the drugs, indicating he knew how unsafe his product was. This Office will not rest until those who peddle this poison have been brought to justice.” DEA Special Agent in Charge Frank A. Tarentino III said: “Data doesn’t lie, and law enforcement continues to track fatal fentanyl poisonings to the person responsible. This arrest is an example of DEA and our law enforcement partners’ efforts to thwart more drug poisonings and bring to justice those responsible for causing the most harm to our communities. I commend the men and women of the Yorktown Police Department, the DEA’s Westchester Resident Office’s Tactical Diversion Squad, and the U.S. Attorney’s Office for the Southern District of New York for their tenacious work on this investigation.”
Yorktown Police Chief Robert Noble said: “It is good for our community to see their local police department request assistance from federal agencies like the DEA and the U.S. Attorney’s Office for the Southern District of New York and have it culminate with the arrest of an alleged dangerous drug dealer. I commend the determination, intelligence, and teamwork demonstrated throughout this investigation. Yorktown is a law and order community. We’ll continue to work hard, share information, and work shoulder to shoulder on our streets with all of our partners in law enforcement to keep it that way.” As alleged in the Complaint:[1] On or about November 10, 2021, FREEMAN sold fentanyl to his victim. Shortly thereafter, the police responded to a report of a burning car in a parking lot in Mohegan Lake, New York, approximately a three-minute drive from FREEMAN’s apartment building. They found a Ford Focus on fire; the victim was in the driver’s seat with his foot on the accelerator pedal. After the fire department put the fire out, the victim, declared dead, was pulled out. Investigators determined that the car caught on fire after overheating while the accelerator pedal was depressed for an excessive period and the car was in park, i.e., while the victim was passed out in the driver’s seat with his foot on the pedal. The Westchester County Medical Examiner’s Office, which is part of the Westchester Department of Laboratories and Research, performed an autopsy on the victim. According to a report prepared by the Department of Laboratories and Research, as well as a conversation between a law enforcement officer and a member of the Medical Examiner’s office, the victim had lethal levels of both fentanyl and norfentanyl, a metabolite of fentanyl, in his blood and there was some darkening of his lungs, which indicated smoke inhalation before his death. Moreover, the victim’s cause of death was certified as both acute fentanyl intoxication and accident. * * * FREEMAN, 37, of Mohegan Lake, New York, is charged with one count of fentanyl distribution resulting in death, which carries a minimum sentence of 20 years in prison and a maximum sentence of life in prison, and one count of illegally possessing ammunition as a convicted felon, which carries a maximum sentence of 15 years in prison. The minimum and maximum potential sentences in this case are prescribed by Congress and are provided here for informational purposes only, as any sentencing of the defendant will be determined by the judge. Mr. Williams praised the outstanding work of the DEA and the Yorktown Police Department. The case is being prosecuted by the Office’s White Plains Division. Assistant U.S. Attorneys Michael D. Maimin and Ben Arad are in charge of the prosecution. The charges contained in the Complaint are merely accusations, and the defendant is presumed innocent unless and until proven guilty. |
