Yorktown Police report the arrest of a 20 year old Stormville, New York man, who is charged with Aggravated Driving While Intoxicated-Child in Car, a Class "E" Felony, Endangering the Welfare of a Child, a Class "A" Misdemeanor, Driving While Intoxicated, an Unclassified Misdemeanor, Operating a Motor Vehicle with a Blood Alcohol Content (BAC) .08 of More, an Unclassified Misdemeanor, Rear Passenger Less Than 4 Years Old Child Seat Violation, Speed Not Reasonable and Prudent, Unsafe Lane Change and Tinted Windows, all Traffic Infractions.
On February 7, 2021, at approximately 11:47 pm, Yorktown Police received a call of a one car motor vehicle accident on Route 6 in the area of Curry Street. PO Ellsworth was dispatched, along with several other officers. Upon arrival, PO Ellsworth met with a male operator, who he identified as the defendant. During the investigation it was determined that in addition to the operator, there was a 1 year old child in the vehicle. P.O. Ellsworth checked on the child and it’s alleged that the 1 year old child was not in a car seat and was seated on the rear seat being restrained by a seatbelt. The child had a cut in the area of his mouth and EMS was dispatched to the scene. The child’s mother was contacted and arrived on scene. The child was then taken to Westchester Medical Center to be evaluated. Following an investigation at the scene, it was determined that the defendant was allegedly driving while intoxicated with a child in the vehicle. He was placed under arrest and transported to the Yorktown Police Department for processing. Upon further investigation at Yorktown Police Headquarters, the defendant was charged with allegedly having a B.A.C. over .08% and endangering the welfare of a child. Following processing on the above charges, the defendant was issued uniform traffic tickets and arraigned in Yorktown Justice Court. Following arraignment, the defendant was released on his own recognizance to appear in Yorktown Justice court on February 25, 2021 at 4:00 pm. Comments are closed.
