The Yorktown Police Department reports the arrest of a 35 year old Yonkers woman, and a 36 year old Yonkers man, who are both charged with Aggravated Driving While Intoxicated ("Leandra's Law" - child in the vehicle), a Class "E" Felony, Endangering the Welfare of a Child, a Class "A" Misdemeanor, and Improperly Restrained Child (No Seatbelt/Child Safety Seat), a traffic infraction. The female defendant is also charged with Driving While Intoxicated BAC of .08% or More, an Unclassified Misdemeanor and Improper Front License Plate, a traffic infraction. The male defendant was also charged with Aggravated Driving While Intoxicated BAC of .18% or More, as well as Aggravated Unlicensed Operation in the 3rd Degree, an Unclassified Misdemeanor.
On June 28, 2018 at approximately 11:20 pm, Yorktown Police Department officers were dispatched to investigate reports of a possible intoxicated driver, driving erratically with children in the vehicle on Lexington Ave. and Crompond Road, as well as driving southbound in the northbound lane on the Taconic State Parkway. Officers conducted a search for the vehicle, which was subsequently located by PO Racioppo on Crompond Road. Prior to making contact with the suspects, the officer observed the male and female switch seats and both operate the vehicle. After stopping the vehicle and conducting a roadside investigation, it was determined that both suspects were drunk and were driving the vehicle with their five and nine year old children in the car. The male suspect was later charged with Aggravated DWI for having a blood alcohol content (BAC) of .18% or more, and the female was charged with DWI for having a BAC of .08% ore more. Both were charged additionally charged with felony DWI under "Leandra's Law." Other charges stem from the male having a suspended driver's license and for not properly restraining the children with seat belts/booster seats. Both defendants were transported to the Yorktown Police Department for arrest processing and the children were brought there as well. The children were turned over to a responsible party a short time later and Westchester County Child Protective Services was made aware of the incident. On June 29, 2018 at 9:15 am, the defendants were arraigned in the Yorktown Justice Court by the Honorable Gary Raniolo. Judge Raniolo issued Temporary Order of Protections on behalf of the children and released each defendant to a responsible party on $1,000 cash bail. Both defendants are scheduled to appear in the Yorktown Justice Court on July 12, 2018 at 6:00 pm. Comments are closed.
