Yorktown Police report the arrest of a 40-year-old Yorktown man, who is charged with False Personation, a Class “B” Misdemeanor, Aggravated Unlicensed Operation 2nd Degree, an Unclassified Misdemeanor, as well as Unlicensed Operator and Following Too Closely, both Traffic Infractions.
On January 4, 2022 at 5:37 PM, Yorktown Police received a report of a property damage auto accident on Route 202. Officer Battista responded to the scene, initiated an investigation and identified the defendant as one of the drivers involved in the accident. The defendant could not produce a driver’s license and provided Officer Battista with a name and date of birth. A DMV check using the information provided showed the defendant was unlicensed and his privilege to operate a motor vehicle was suspended. At the conclusion of the investigation at the scene it is alleged that the defendant was following too closely, operating a vehicle while unlicensed, and operating a vehicle while his privilege to do so was suspended. The defendant was issued traffic tickets for those charges and released on his own recognizance. Upon additional investigation at the Yorktown Police Department, Officer Battista discovered that the name and date of birth given by the defendant was false information. Officer Battista was able to obtain the actual name and date of birth of the defendant and found that he was unlicensed and his privilege to operate a motor vehicle was revoked. It is alleged that the defendant gave Officer Battista false information with the intent to prevent him from ascertaining his true identity. On January 5, 2022 at 2:04 PM, Officer Battista located the defendant outside his residence and placed him under arrest for false personation. The defendant was transported to the Yorktown Police Department for arrest processing. After processing the defendant was issued traffic tickets and an appearance ticket for the above charges and released on his own recognizance. The defendant is due to appear in the Yorktown Justice Court on January 20, 2022 at 6:00 PM. Comments are closed.
