Yorktown Man Charged with Felony DWI Under "Leandra's Law" After Dropping Kids Off at School10/4/2019
Yorktown Police report the arrest of a 34 year old Yorktown man, who is charged with Driving While Intoxicated, an Unclassified Misdemeanor, Aggravated DWI with BAC .18% or More, an Unclassified Misdemeanor, two counts of Aggravated DWI with a Child in the Car ("Leandra's Law"), a Class "E" Felony, two counts of Endangering the Welfare of a Child, a Class "A" Misdemeanor, and False Personation, a Class "B" Misdemeanor. Additionally, an unrelated Bench Warrant for underlying charges of DWI and Refusal to Take a Breath Test and a second unrelated Bench Warrant for Failure to Appear, underlying charge of Harassment 2nd Degree, were executed on the defendant.
According to police on October 4, 2019 at approximately 9:04 am, Officer Curtis, who was working as the School Resource Officer at the George Washington Elementary School, was alerted by a staff member that a man had just dropped his two daughters off at school and appeared to be intoxicated. Officer Curtis stopped the man in question as he was driving out of the parking lot and identified him as the defendant. Officer Premuto arrived on scene to assist and both officers initiated an investigation. That investigation revealed that the defendant operated the vehicle while intoxicated with a blood alcohol content greater than .18% while his two daughters, ages 5 and 6, were in the vehicle. During the course of the investigation the defendant gave a false name to the officers, leading to the charge of False Personation. The defendant was placed under arrest and transported to the Yorktown Police Department for processing. While in custody, the defendant was found to have to active Bench Warrants from the Yorktown Justice Court which were both executed. The defendant was arraigned in Yorktown Justice Court by the Honorable Gary Raniolo on the above charges and active Bench Warrants. Following arraignment, the defendant was remanded to the Westchester County Jail in lieu of $10,000 bail or bond. The defendant is due to appear in the Yorktown Justice Court on October 17, 2019 at 6:00 pm. Comments are closed.
